Terms and Conditions

A. C. E., Inc. is Process Server forwarding agents. We do not employ lawyers and in no way provide any form of legal advice. If you are sending us Federal or State court documents and your rules are different from the where we are assisting you, you should research the applicable statutes and notify us of the methods and requirements for your specific service. We will not make legal decision as to how your service will be handled.

Courier
We prefer not to accept your service request via courier. We usually accept service by email or facsimile. We charge for each page we have to copy. If your service documents have to be sent via courier please notify us immediately so we can make special arrangements to accommodate your needs.

Affidavits
Affidavits of Service or “Proofs” will generally be returned by U.S. mail within 7 days. Our Affidavits are notarized and offered as part of the service and no additional cost.

Warranty and Disclaimer:
LIMITATION OF LIABILITY- A. C. E., Inc.
LIABILITY FOR LOSS, DAMAGE, DELAY, NON-DELIVERY OR MIS-DELIVERY OF A SERVICE SHALL BE LIMITED TO THE ACTUAL VALUE OF SUCH SERVICE. In the event that any A. C. E., Inc. service is determined to be improper, A. C. E., Inc. will refund to the client all charges for those particular services. This sum shall be complete and not as a penalty. IN NO EVENT SHALL A. C. E., Inc. BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL OR SPECIAL DAMAGES that may arise from the loss, damage, delay, non-delivery or mis-delivery of any service. This limitation shall apply to and include, but not be limited to, damages for loss of profit, loss of income or a loss of bargain or loss of time. Due to the nature of the business, A. C. E., Inc. will not be liable, except as provided herein, for failure to deliver by a stipulated timely date.

Account and Payment Terms:
All services are prepaid and payable by Credit Card or Law Firm Check ONLY

Finance Charges
In some cases we may have to send you an invoice. All invoices not paid within thirty (15) days are assessed a finance charge of 1.5% per month or 18% per year, compounded monthly.

Disputed Charges
All disputes regarding services or charges for those services must be made in writing within (10) days of the customer's receipt of the invoice for those services. All written disputes must have a copy of the disputed invoice attached. Disputes not made in the above-referenced manner will be deemed a waiver of any future dispute regarding the same and an acceptance of the services rendered hereunder.

Jurisdiction.
Any agreement to provide services by A. C. E., Inc. shall be governed by the laws of the State of Florida. Any disputes arising out of the terms contained in any invoice and/or services rendered pursuant to the same shall be governed by the laws of the State of Florida only. Any party to this agreement shall be subject to the jurisdiction of the courts of the State of Florida.

Attorneys' Fees and Costs.
All costs and attorneys' fees incurred in the collection of any sums due and owing on any invoice shall be the sole responsibility of the client. After service is complete, any and all additional time spent preparing for, appearing at or engaging in any meeting, deposition or similar venue shall be billed hourly and paid for in advance. If any type of litigation is borne out of services rendered the client is solely responsible for all legal fees, court courts, expenses and billable hours for all services. A. C. E., Inc. is not responsible for any expenses or fees whatsoever.

Acceptance of Terms:
When you hire A. C. E., Inc. it is understood you read all of the above terms and conditions and agree to every aspect. Therefore, you are holding A. C. E., Inc. harmless and not responsible any and all conflicts that may arise as a result of services rendered.
